The congress could very well legislate that children born in America to illegal immigrants not be afforded citizenship. There's nothing racist about that. That wouldn't mean a repeal of the 14th amendment.

This ruling was made over a 110 years ago in 1898.
If this is what they've been basing all of the legal rulings on since, which allow the abuse of our system by a loophole, technicality or mere oversight, I say it's time for a new case and a new ruling.

Overturned the previous Supreme Court ruling in Plessy vs. Ferguson that stated segregated facilities for blacks and whites are constitutional under the doctrine of "separate but equal"
District of Columbia vs. Heller
Ruled that the 2nd Amendment protection applies to the people and not the state
The Lilly Ledbetter Act
An Act of Congress which negated a Supreme Court Ruling which says that an employer can only be sued if the discriminary acts are discovered and the lawsuit brought within 180 days of the first act. The Ledletter Act now starts the 180 day statute of limitations clock running all over again with each paycheck issued.

Its not hate its about money. Anchor babies are a drain on the system. The mothers are immediately eligible for Food stamps, Health care, welfare and section 8. Its not a small fraction that gets these programs almost every single one of them qualifies.
Do we stop Anchor babies or let it continue to drain every single state until funding of these programs are cut. The bill affects all races equally it does not specifically target Hispanics. These are important programs that Americans need.
Screaming hate and racism is just sad.

Whether you (or I for that matter) like it or not those babies are citizens of the United States of America, protected under the Fourteenth Amendment of the Constitution. Cute term by the way demeaning people and making a case of second class citizens. You want to change the following:
Section 1. All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside. No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.
Then change the Constitution.

Most of the countries that have illegals here do not allow those who are illegal there to have any opportunity for citizenship. They tend to prosecute their illegals too. Most of the non-third world countries tend to PROTECT their borders and deal with those who cross the border without permission. Mexico is CRAZY!

There are instances when a child is born within the borders of the US, and is NOT granted US citizenship. i.e. child of a diplomat, child born on a foreign vessel or aircraft....Since we can make exceptions for these, why not for the children of illegal aliens? If we cannot or will not change the law, then by all means, let the children stay. But, the parents have to go. They can take the child with them if they desire, or they can foster the child to a LEGAL relative or friend, but the parents have to go. If the parents decide to take the child home, fine. When the child reaches 18 years old, and if they wish to return, they will be welcomed home as a returning US citizen.

If you are born on a foreign vessel or aircraft you aren't technically born in the United States. You are born in the country operating that vessel. In the same way when you enter the United Nations, you are no longer in the United States, despite being in the middle of Manhattan.
Likewise, a foreign diplomat, service person etc, is in the service of a foreign government, their child might be born in a civilian hospital, but they, by the nature of their job are an extension of the country they represent.
That, I believe, is the difference.

Let him introduce an amendment, then. They can debate it in Congress. Unlike the Republicans, my guess is that the Democrats will actually permit a debate and seek a resolution. Write the bill, Mr. Hunter, or have an assistant write it for you.

Regretfully, there are not enough "old Righters" and "progressives" left in the Republican Party to rebuild it after the new right/christian right nuts are done thanks to their "purity" criteria. The Republican Party started out as a progressive party so under todays standard the Christian New Right are the real RINO's not the moderates and few old righters. Glen Beck and others need a GOP History lesson. They should go away. I was always a "progressive" Republican but I won't be a Democrat. If I have to leave the GOP, I'd rather be a Federalist.

guess the illegal immigrant parents should have thought about that in advance and if the child is that young then the parents are the ones that would make the decision for it just like any parent has to make decisions for their children before they can make them for themselves, and guess what some of the children may not have made the same decision if they were able to but that is the way the world works

I have personally witnessed immigrants, who have intentionally gotten pregnant and have children after their visa expired. The law was originally intended to grant citizenship to former slaves and their children. The context in which it is being used(misused)is an offense to the intelligence of even the most feebleminded imbecile.

Who here is arguing that it is being used correctly? The fact that it is being misused doesn't make it not an amendment, or a constitutional right which the Supreme Court has upheld since.
I think people misuse a lot of their constitutional rights, such as the right to bear arms, but I don't advocate that we should repeal the 2nd amendment or force people to hand over their guns.

Citizenship gained by ILLEGAL means should be null and void. PERIOD.
Do the children of a bank robber get to keep the money the parent stole. No. The money was gained by illegal means. So a child that gains citizenship because of the illegal activity of the parents should not have that citizenship given to them.
If I was a person immigrating to the U.S. and I falsify information to get here should I be able to stay when that false information is found out? No.
Citizenship by birth should ONLY be granted to those children born to U.S. citizen mothers. All others are NOT citizens by birth. The wrong interpretation of the amendment is one of the reasons we are in this mess. FIX the interpretation and you remove 1 of the reason to cross the border illegally.

Your analogy of the bank robber is flawed because it assumes that children earn their citizenship through the status of their parents- they don't. Now, if the parents were not actually Americans and wrongfully claiming so, and had their children outside of the United States and tried to apply for their children to be American by virtue of having American parents...the analagy would work. That's not what we are talking about.

What about U.S citizen fathers? I have no problem with people born within the borders of the United States being granted American citizenship. Immigration problems should be addressed without affecting the rights of naturally born citizens.

Yes that was the original intention, but that is not all it is limited to. If they had wanted it to ONLY be limited to freed slaves they would have said so. They didn't, they said:

If your 36 years occurred in the first part of the 20th century, then sure, the party was overrun with Dixiecrats, but I'd like to see you prove that democrats are currently more bigoted than republicans. I would argue that racism, sexism, homophobia etc. are all related more strongly with social conservatism. Are their bigoted democrats? Of course, but social conservatism is more closely tied (though not exclusively) with the current republican party.

The alternative to his plan to deport US born children along with their illegal alien parents is to deport the parents and put the US born children up for adoption. Actually, I favor this idea because there are a lot of US couples in the USA who want to adopt and these kids would fulfill a need.
Illegal aliens would hesitate to give birth in the USA if they knew they would lose custody of their US born children. It would be a big discouragement. I favor any plan which will discourage illegal immigrants from coming to the USA and taking advantage of US services paid for with the tax money of LEGAL US citizens.

actually, in many other countries the children would have dual citizenship and would be allowed to stay with a legal guardian if the parents were deported. otherwise they would be allowed to return as adults or if sponsored by a legal family

IN the USA if someone with custody of a child is charged with a felony, Child Protective Services usually gets the kids. They put them with relatives or put them in foster care. Illegal aliens by definition have broken Federal laws and should be treated no different from other felons. That means they can lose custody of their kids.
Perhaps if we instituted a policy of removing children from their law breaking illegal immigrant parents--it would discourage them from coming to the US and having children here. It would also be enforcing the laws equally for all law breakers. By definition illegal aliens are law breakers.
I never said life was fair nor a bowl of cherries. I am just stating what the alternatives are and what happens to most USA citizens with custody of children when they are accused of felonies.

A friend of mine worked for a company and lived in Mexico for over 2 years. While there he fell in love with a Mexican woman. They took the legal route and got married in Mexico and then in the USA while she was here on a tourist VISA. It took over 2 years to get her a green card so she could come to the USA. WHY--because Immigration and Naturalization Offices spend the bulk of their time and budget on illegal aliens. During that 2 year wait for a green card she could not enter the USA. He had to fly to Mexico to be with his wife while they waited on the bureaucracy. She is a naturalized USA citizen now and they have 3 children--all born in the USA. They took the legal route and suffered because of all the illegal aliens gumming up the bureaucratic works.
